Trust protector
services
As the protector, the UMA Group carries out selected tasks and duties for the settlor or the family. Over time these tasks and responsibilities may be adjusted to suit circumstance and needs.
Tasks and duties may include:
- Providing consent or otherwise to actions proposed by trustees
- Conflict of interest situations
- Performing periodic reviews of trust activities
- Reporting to settlors and beneficiaries and attending trustee meetings
- Becoming successor protectors to existing trust structures
- Acting as an authorised applicant or as an enforcer to a purpose trust
- Part of Protector Committee

Trustee
Services
- UMA Swiss AG is approved by FINMA to provide Dedicated Trustee Services (DTCs).
- The new FINMA regulation introduced DTCs as a type of private trust company. DTCs are independent of the family, and can only be held and supervised by a FINMA licensed financial institution authorized to provide services as a Trustee (to protect customers and the functioning of the financial market). DTCs offer full flexibility in terms of governance evolving in the concept of a Swiss single-family office.
- On the level of the DTCs, a family can select trusted advisors or family members to form part of the Board of the DTCs and can tailor-made other business governance methods and/or services in line with traditions family office services practices.
- As opposed to the needed exemption by FINMA for Private Trustee Companies, DTCs are not controlled by the family for the benefit of which the Trust has been established, but by a FINMA licensed trustee.
- Unlike Private Trustee Companies in Switzerland, it is not required with a DTC for the settlor and beneficiaries to be connected by family ties.
- Further, DTCs can be Trustee of several Trusts settled by one of more settlors for the benefit of the same family.
- A FINMA Trustee License exemption is not automatically applicable to DTCs. DTCs may be exempt by FINMA from the requirement to obtain a license upon request only. Accordingly, an application for relief from the licensing requirement must be submitted for each DTC. UMA Swiss AG can take care of this process.
